In my quest for documentation and explanation, I decided to contact my prior dentists that date back about 20 years and request copies of my medical records.
The 1st dental receptionist said that I couldn't have my records. When I questioned her further, her stance was that they could not release my x-rays to me. Once I told her that I only wanted the paper records, she said fine and they were promptly mailed to me.
My more recent dentist's receptionist told me in no uncertain terms that I could not have my records. I tried telling her I didn't want x-rays (since that worked with the 1st one). Then she suspiciously demanded to know why I wanted them. I was really annoyed by this-it is none of her business. However, I kept my cool and told her that I have had health issues and am compiling all of my medical and dental records (as non-threatening as I could sound). Finally, she said she might be able to send a redacted version, with certain things whited out, but she would have to ask the dentist if he would allow it. He agreed to release the records, and we'll see how long it takes to get thems.
My point is that you have a right to have a copy of your records, including the x-rays, if so desired. I did not feel like arguing that point because I didn't need them for trying to establish a chronology. They have the right to require you to pay for copying and mailing, but you still have the right to have them, and some states dictate a time frame within which the provider must comply with your request.
I was not fully surprised, but still a little taken aback that my providers would try to deny me those records. I did not cite the statutes for them nor indicate my legal training because usually you get more flies with honey, so I tried the "nice" way first. They must really be afraid of lawsuits to try to illegally deny patients access to their own records.
I'm probably preaching to the choir, because you all are here because you dare to question the "authority", but I thought I'd share my experience.

Hi, Are you from US lawstudent?
I'm asking as I tried to obtain dental records from my previous dentist but was told they are destroyed after 7 years. I'm from UK - has anyone else from UK come across this?
